1. Agreement to Terms

By accessing or using inst4youBot ("the Service," "we," "our," or "the Bot"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

The Service is operated as a personal project and provides Instagram and TikTok content downloading functionality through the Telegram platform.

2. Service Description

2.1 What We Provide

inst4youBot is a Telegram bot that allows users to:

• Download posts, reels, stories, and highlights from public Instagram accounts
• Download videos from public TikTok accounts
• Access profile information from Instagram and TikTok
• Automatically receive new stories from subscribed accounts (Premium feature)

2.2 Free vs Premium

Free Users:

• 1 download request every 8 hours
• Access to basic download features
• Standard support

Premium Users:

• Unlimited downloads
• Auto-watch stories feature (/watch command)
• Priority support

2.3 Content Limitations

The Service can only access and download content from:

• Public accounts: We cannot download content from private or restricted accounts
• Available content: Stories expire after 24 hours; we cannot retrieve expired content
• Platform limitations: Service depends on Instagram and TikTok API availability

3. User Obligations and Acceptable Use

3.1 Personal Use Only

You agree to use the Service:

• Only for personal, non-commercial purposes
• In compliance with all applicable laws and regulations
• Without violating intellectual property rights or copyright laws

3.2 Prohibited Activities

You agree NOT to:

• Use the Service for spam, harassment, or abusive purposes
• Download content for commercial redistribution or sale
• Attempt to circumvent rate limits or service restrictions
• Reverse engineer, decompile, or hack the bot
• Use automated tools or bots to interact with the Service
• Violate Instagram's or TikTok's Terms of Service
• Infringe on copyright, trademark, or other intellectual property rights

3.3 Copyright Responsibility

Important: You are solely responsible for ensuring that your use of downloaded content complies with copyright laws and the intellectual property rights of content creators. We provide a download tool; we do not grant you rights to the content itself.

4. Payment Terms

4.1 Payment Method

We use Telegram Stars as the exclusive payment method for premium subscriptions. All payments are processed through the Telegram platform.

4.2 Pricing

Premium subscription plans:

• 1 Day: 30 Telegram Stars
• 1 Week: 70 Telegram Stars
• 1 Month: 150 Telegram Stars
• 3 Months: 400 Telegram Stars
• 6 Months: 700 Telegram Stars

Prices are subject to change. Current users will be notified before price changes affect their subscriptions.

4.3 Subscription Terms

• Subscriptions are non-recurring (no automatic renewal)
• Access is granted immediately upon successful payment
• Subscription time begins at the moment of purchase
• No refunds for partially used subscription periods

4.4 Payment Processing

We do not process payments directly or store any payment information. All transactions are handled securely by Telegram. By making a purchase, you agree to Telegram's payment terms and policies.

5. Refund Policy

5.1 Standard Refund Policy

We follow Telegram's standard refund policy:

• Refund requests must be submitted within 72 hours from purchase
• Refunds are only available if premium features were not used
• All refunds are processed through Telegram support
• Contact @i4youHelpBot with your purchase details

5.2 Short-Term Subscriptions

1-day subscriptions are generally non-refundable due to their short duration. However, exceptions may be made in cases of technical issues or service unavailability on our end.

5.3 Technical Issues

If the Service experiences technical problems or extended downtime (more than 4 hours):

• We will extend your subscription by the equivalent downtime period, OR
• Provide a full refund upon request, regardless of subscription duration

5.4 How to Request a Refund

3. Explain the reason for the refund request
4. We will review and respond within 48 hours

6. Service Availability and Limitations

6.1 "AS-IS" Service

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We do not guarantee:

• 100% uptime or uninterrupted access
• Compatibility with all Telegram clients
• Availability of Instagram or TikTok content
• Error-free operation

6.2 Third-Party Dependencies

Our Service depends on Instagram, TikTok, and Telegram platforms. We are not responsible for:

• Changes to Instagram or TikTok APIs that affect functionality
• Content removal or unavailability on those platforms
• Telegram platform downtime or issues
• Account suspensions or restrictions by Instagram or TikTok

6.3 Maintenance and Updates

We may temporarily suspend the Service for maintenance, updates, or improvements. We will attempt to provide advance notice when possible.

7. Intellectual Property

7.1 Service Ownership

inst4youBot, including its code, design, and branding, is owned by the service operator. You may not copy, modify, or distribute the bot without permission.

7.2 Downloaded Content

Content downloaded through the Service (videos, images, etc.) remains the intellectual property of the original creators. We do not claim ownership of any downloaded content.

7.3 Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content downloaded via our Service infringes your copyright:

• Contact the platform where the content is hosted (Instagram or TikTok)

Note: We do not store downloaded content. We only provide a tool for users to access publicly available content.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Any damages arising from your use of the Service
• Loss of data, profits, or business opportunities
• Copyright infringement by users
• Violations of third-party terms of service (Instagram, TikTok)
• Service interruptions or errors
• Actions taken by Instagram, TikTok, or Telegram against your accounts

Your use of the Service is at your own risk. Our total liability shall not exceed the amount you paid for premium subscription (if any) in the past 3 months.

9. Account Termination

9.1 Termination by You

You may stop using the Service at any time by blocking the bot or requesting data deletion.

9.2 Termination by Us

We reserve the right to suspend or terminate your access if:

• You violate these Terms of Service
• You abuse the Service (spam, excessive requests, etc.)
• You engage in illegal activities
• Required by law or legal authorities

Terminated accounts are not eligible for refunds unless termination was due to our error.

10. Disclaimers

10.1 No Affiliation

inst4youBot is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, Meta Platforms, ByteDance, or Telegram. All trademarks belong to their respective owners.

10.2 No Warranties

We provide the Service "as-is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.3 Legal Compliance

You are responsible for ensuring your use of the Service complies with all applicable laws in your jurisdiction, including copyright and intellectual property laws.

11. Changes to Terms

We may update these Terms of Service at any time. Changes will be effective when posted. We will notify users of significant changes through:

• Updating the "Last Updated" date at the top
• Notification through the bot (for major changes)
• Announcement on the website

Your continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with international law principles and the laws applicable to personal service providers.

Any disputes arising from these Terms or your use of the Service should be resolved through good-faith negotiation. If resolution cannot be reached, disputes will be handled according to the laws of your jurisdiction.

12.1 Regional Compliance

• EU Users: We comply with GDPR and EU consumer protection laws
• US Users: We comply with applicable federal and state laws, including CCPA for California residents

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
